Terms and conditions

Last updated: 25 October 2026

These are the general terms and conditions of FortCRM, registered with the Dutch Chamber of Commerce under number 42105837. We kept them short and in plain language. This English version is a translation; if the versions differ, the Dutch version applies. Questions? Email [email protected].

1. Scope

1.1 These terms apply to all quotes, projects and support plans from FortCRM. “Client” means the organisation that engages us.

1.2 Agreements that differ from these terms only apply if we have confirmed them in writing (email counts).

1.3 The client’s own general terms do not apply.

2. Quote and engagement

2.1 Our quotes are valid for 30 days, unless the quote states otherwise.

2.2 The engagement starts as soon as the client accepts the quote digitally or in writing.

2.3 The scope of the work is set out in the quote. Extra work during the implementation is only done after the client accepts an additional quote. Extra hours after go-live are charged at the hourly rates in the quote, monthly in arrears.

3. Delivery

3.1 We carry out the work to the best of our ability, with the care you can expect from a skilled service provider. This is a best-efforts obligation, not a guaranteed result, except where we explicitly guarantee something (article 5).

3.2 The client provides what we need on time: access to systems, correct data, and people who are available for sessions and decisions. Delays caused by missing input are at the client’s expense.

3.3 We may have parts of the work carried out by carefully selected third parties. We remain responsible for the work.

3.4 The client takes out its own Pipedrive subscription and remains the owner of that account. Integrations with other software (such as n8n, accounting packages or AI services) are also subject to those suppliers’ terms. We are not responsible for outages, changes or price increases at those parties.

4. Prices and payment

4.1 All prices are in euros and exclude VAT.

4.2 Pipedrive licences are not included in our prices. The client pays them directly to Pipedrive.

4.3 We invoice implementations in two parts: 50% when the quote is accepted and 50% when the setup goes live.

4.4 Support plans are invoiced per calendar month in advance, starting with the first full calendar month after the free trial month.

4.5 Payment is due within 14 days of the invoice date. If the client pays late, we send a reminder. If payment is still not made, we may suspend the work and charge statutory interest and reasonable collection costs.

4.6 We may adjust support plan rates once a year, with at least one month’s notice. The client may then cancel the plan as of the date the new rate applies.

5. Guarantee

5.1 With the Shared and Fully managed packages we offer this guarantee:

  • Live fast. If the setup is not live within 6 weeks of the start, we refund the client’s Pipedrive licence costs for the period of the overrun.
  • Active use. If the team is not actively using the system 60 days after go-live, we provide an extra training at no cost.

5.2 The guarantee does not apply if the delay or lack of use is caused by the client not meeting article 3.2, or by the client changing the scope during the project.

5.3 After go-live there is a 30-day aftercare period. We fix errors in our setup that come to light during that period at no cost.

6. Support plans

6.1 A support plan (SLA) starts at go-live with a free trial month. After that it runs per calendar month and renews automatically each month.

6.2 Either party can cancel the plan with one month’s notice, effective at the end of a calendar month.

6.3 What the plan includes, such as hours, response times and channels, is set out in the quote or on our packages page. Unused hours expire at the end of the month.

7. Intellectual property

7.1 Once paid in full, the client may keep using and adapting everything we set up for them without limitation, including after the collaboration ends. This covers the Pipedrive setup, workflows, templates and documentation.

7.2 Ownership of reusable components, such as standard workflows, templates, methods and know-how, remains with FortCRM. We may use them for other clients, without the client’s confidential data.

7.3 The data in the client’s Pipedrive account is and remains the client’s.

8. Liability

8.1 Our liability is limited to direct damage and to no more than the amount the client paid for the project concerned. For a support plan, it is limited to the amount of the last three months.

8.2 We are not liable for indirect damage, such as lost profit, lost revenue or loss of data. The client remains responsible for backups of its data.

8.3 These limits do not apply in case of intent or deliberate recklessness by FortCRM.

8.4 The client must report a claim to us in writing within 12 months after the damage became known. After that, the right to compensation lapses.

9. Confidentiality and privacy

9.1 We treat all client information as confidential and do not share it with others, unless needed for the work or required by law.

9.2 If we process personal data on behalf of the client, we sign a data processing agreement. How we handle personal data ourselves is described in our privacy statement.

10. Force majeure

If force majeure prevents us from meeting our commitments, such as a supplier outage, illness or government measures, those commitments are postponed for as long as it lasts. If it lasts longer than 60 days, either party may end the project in writing. Work already delivered is invoiced proportionally.

11. Termination

11.1 An implementation project ends on delivery. The client can stop a project in progress. The client then pays for the work done up to that point, with the first 50% invoice as a minimum.

11.2 Either party may end the collaboration immediately if the other goes bankrupt, is granted a suspension of payments, or fails to meet its obligations after a written notice of default.

11.3 When the collaboration ends, we make sure the client has full access to its account and documentation, and we revoke our own access.

12. Governing law

All agreements with FortCRM are governed by Dutch law. Disputes are submitted to the competent court in the district where FortCRM is established, after we have first tried to resolve them together.
